These Terms of Service (the “Terms” or “Agreement”) govern your access to and use of the Service provided by Ethos solutions, MB, company number 306689726, registered office at Gėlių g. 4, Didžiulių k., LT-60295 Raseinių r., Lithuania, (the “Service Provider”, “Company”, “we”, “us”, “our”).
By creating an Account, purchasing a Subscription, or using the Service, you confirm that you have read, understood, and agree to be bound by these Terms. If you do not agree, do not use the Service.
1. Eligibility and acceptance
1.1. Age. You must be at least 18 years old (or the age of majority where you live, if higher) to use the Service.
1.2. Capacity. You represent that you have the legal capacity to enter into this Agreement.
1.3. Account requirement. You must create an Account to access the Service and any Subscription features.
2. Definitions
2.1. Account: your registered user profile on the Service.
2.2. Journal Entry / Entry: content you create within the Service, including text and associated metadata.
2.3. Submitted Entries: the specific Entries (or portions) that you explicitly select and submit for review using the Service’s submission function.
2.4. Review (Diary Review): asynchronous written feedback delivered within the Service regarding Submitted Entries.
2.5. Partner: a psychologist or other professional who may prepare Reviews.
2.6. Subscription: a paid plan granting access to premium features and Review entitlements.
2.7. Review Week: each consecutive rolling seven (7) day period beginning at the Subscription Start Time.
2.8. Consumer: a natural person acting for purposes outside their trade, business, or profession.
3. The Service
3.1. What we provide. The Company provides the technical Service, including: (a) Account creation and management; (b) storage and organization of Entries; (c) tools to select and submit Entries for Review; (d) delivery of Reviews; (e) Subscription and payment handling.
3.2. Asynchronous by design. The Service is primarily asynchronous. It does not provide real-time chat, crisis monitoring, or guaranteed response times.
3.3. Changes to the Service. We may modify, update, suspend, or discontinue parts of the Service at any time.
4. Account and security
4.1. Accurate information. You agree to provide accurate information and keep it up to date.
4.2. Credential confidentiality. You must keep your login credentials confidential and secure.
4.3. Responsibility for activity. You are responsible for all activity under your Account.
4.5. No account sharing. Accounts are personal and may not be shared.
5. Journaling content
5.1. Your control. You decide what you write, store, and submit for Review.
5.2. Your responsibility. You are solely responsible for your Entries and for deciding whether to record or submit any sensitive information.
6. Reviews: minimum entitlement, conditions, and timing
6.1 Minimum Weekly Review
6.1.1. With an active Subscription that includes Reviews, the Company will provide at least one (1) Review per Review Week.
6.2 Submission requirements
6.2.1. To receive the Minimum Weekly Review, you must submit Submitted Entries during that Review Week.
6.3 Reasonable use
The Minimum Weekly Review is subject to reasonable use (including limits on length). If submission is excessive, we may limit the Review.
6.4 Timing
We use reasonable efforts to deliver Reviews promptly but do not guarantee specific delivery times.
6.5 Delays
Delays do not entitle you to compensation, except where mandatory law requires otherwise.
6.7 Right to refuse
We may refuse to provide a Review if content is abusive, illegal, or violates safety/ethics.
7. Partner qualification and responsibility boundaries
7.1. Credential checks. We use reasonable efforts to ensure Partners are qualified.
7.2. Professional judgment. Reviews reflect the Partner’s professional judgment and may be subjective.
7.3. Responsibility limits. To the maximum extent permitted by law, the Company is not responsible for a Partner’s professional opinions or outcomes.
8. What the Service is (and is not)
8.1. Not therapy. The Service and Reviews are for informational/reflective purposes only. They are not psychotherapy or medical treatment.
8.2. No emergency use. Do not use the Service for emergencies. Contact emergency services if in danger.
8.3. No monitoring. We do not monitor Entries in real time.
9. Subscriptions, pricing, and payments
9.1. Pricing. Set by the Company.
9.2. Automatic renewal. Subscriptions renew automatically unless cancelled.
9.3. Cancellation. You may cancel at any time. Effective at end of period.
9.4. Refunds. Fees are non-refundable unless required by law.
9.9. Right of withdrawal (EEA Consumers). You have 14 days to withdraw from the contract.
10. User content: ownership and license
10.1. Ownership. You retain all rights in your Entries.
10.2. License. You grant us a limited license to use User Content to operate the Service and provide Reviews.
11. Intellectual property
The Service is owned by the Company.
12. Acceptable use and prohibited content
You agree not to use the Service unlawfully, abusively, or to violate rights. We may terminate accounts for violations. Contractual penalties may apply for specific breaches (e.g. sharing account access).
13. Moderation, suspension, and termination
We may suspend/terminate Accounts for violations or security reasons.
14. No AI functionality (current product state)
The Service does not currently use AI to analyze Entries or generate Reviews.
15. Availability, maintenance, and backups
Service provided "as is". We do not guarantee uninterrupted operation. Keep your own copies of content.
16. Privacy and data protection
We process data according to the Privacy Policy and GDPR.
17. Disclaimers and limitation of liability
We disclaim warranties to the extent permitted by law. Liability is limited for indirect damages.

19. Governing law and jurisdiction
Governed by Lithuanian law. Disputes in Lithuanian courts.
20. Changes to these Terms
We may update these Terms. Material changes notified via Service/email.
21. Miscellaneous
If any provision is invalid, others remain. User death leads to account closure.
